Agreement to Terms

Welcome to KANAFANI Sweets & Coffee. These Terms of Service ("Terms") govern your access to and use of our website kanafani.ca and our services, including our loyalty rewards program.

By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Our Services

KANAFANI Sweets & Coffee provides:

• Authentic Palestinian sweets and specialty coffee at our retail locations
• Catering services for events and special occasions
• Online loyalty rewards program
• Newsletter and promotional communications
• Information about our products, locations, and services

Account Registration

Creating an Account

To access certain features of our services, including the loyalty rewards program, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate and current
• Keep your account credentials secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Account Eligibility

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

Loyalty Rewards Program

Program Overview

Our loyalty rewards program allows you to earn and redeem points for purchases at our locations. By participating in the program, you agree to these terms.

Earning Points

• You will receive welcome bonus points upon account creation and email verification (current bonus amount displayed during signup)
• Additional points can be earned through qualifying purchases and promotions
• Points are credited to your account after purchase verification
• We reserve the right to modify point earning rates at any time

Tier System

Our program includes four tiers: Bronze, Silver, Gold, and Platinum (VIP). Your tier is determined by your lifetime spend and provides bonus point multipliers on purchases.

Redeeming Points

• Points can be redeemed for products and services at our locations (when program launches)
• Points have no cash value and cannot be transferred or sold
• Minimum redemption amounts may apply
• Points cannot be combined with certain offers or promotions

Point Expiration

Points expire 12 months from the date they are earned. We use a First-In-First-Out (FIFO) system, meaning your oldest points are used first when you redeem. You will receive email notifications at 30, 7, and 1 day before your points expire.

Program Modifications

We reserve the right to modify, suspend, or terminate the loyalty rewards program at any time. We will provide reasonable notice of material changes.

Acceptable Use

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services
• Create multiple accounts to abuse the loyalty program
• Engage in fraudulent activities or point manipulation
• Harass, abuse, or harm other users or our staff
• Impersonate any person or entity
• Collect or harvest information about other users

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of KANAFANI Sweets & Coffee and is protected by copyright, trademark, and other intellectual property laws.

You may not use, copy, reproduce, modify, distribute, or display any content from our website without our prior written permission.

Catering Orders

When placing a catering order:

• Orders must be placed in advance (minimum 24-48 hours notice required)
• Prices are subject to change without notice
• We reserve the right to refuse or cancel any order
• Cancellation policies apply and may include fees
• Delivery and setup fees may apply
• You are responsible for providing accurate delivery information

Disclaimers and Limitations of Liability

Service Availability

Our services are provided "as is" and "as available." We do not guarantee that our website or services will be uninterrupted, secure, or error-free. We reserve the right to modify or discontinue services at any time without notice.

Food Allergies

Our products may contain or come into contact with common allergens including nuts, dairy, eggs, and wheat. Please inform our staff of any allergies or dietary restrictions. We cannot guarantee that our products are allergen-free.

Limitation of Liability

To the fullest extent permitted by law, KANAFANI Sweets & Coffee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, including but not limited to loss of profits, data, or business opportunities.

Indemnification

You agree to indemnify and hold harmless KANAFANI Sweets & Coffee, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of our services or violation of these Terms.

Privacy

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

Termination

We reserve the right to suspend or terminate your account and access to our services at our sole discretion, without notice, for any reason, including but not limited to:

• Fraudulent or abusive behavior
• Extended period of inactivity
• At your request

Upon termination, your right to use our services will immediately cease. Accumulated loyalty points may be forfeited upon account termination.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
